Changes to the Markets in Financial Instruments Act (ZTFI – 1C) were published in the Official Gazette nr. 45 on 4th of June 2024 and are valid from 15th of June 2024.
Main change relevant to international clients is the definition of the financial instrument for the purpose of defining the investment services and transactions, whereby financial instruments are also financial instruments issued based on distributed ledger technology, as specified in Regulation 2022/858/EU (DLT Pilot regime).
Following Directives were transposed into the amended Act:
- Directive (EU) 2022/2464/EU of the European Parliament and of the Council of 14 December 2022 on corporate sustainability reporting.
- Regulation (EU) no. 2020/852 of the European Parliament and of the Council of 18 June 2020 establishing a framework to promote sustainable investment.
- Regulates in more detail the implementation of Regulation (EU) no. 909/2014 of the European Parliament and of the Council of 23 July 2014 on improving the regulation of securities settlements in the European Union and on central depository companies and Regulation (EU) no. 2020/852 of the European Parliament and of the Council of 18 June 2020 on the establishment of a framework to promote sustainable investments.
- New articles that refer to the regulation of the central depository company were added.
