Update on UC RUSAL ordinary shares: settlement specifics
Wed, 29/09/2021

Further to our Newsflash dated July 15, 2021 on the specifics of settlement and asset servicing of UC RUSAL ordinary shares (ISIN RU000A1025V3) please be advised of the following:

According to clarifications provided by the National Settlement Depository (NSD), no transactions in the HK line of UC RUSAL shares will be accepted for settlement via the NSD apart from those, which are connected with the debiting of the NSD’s account at Euroclear. The NSD will not accept instructions for crediting new HK line positions from its depositors.

Taking into account these limitations, for those of our clients that currently do not keep the HK line in AO UniCredit Bank, they may provide us with the following MT599 standing instruction to streamline the settlement process for all future transactions in the RU line of UC RUSAL:

MT599 template:

ATTN. GLOBAL SECURITIES SERVICES
WE HEREBY REQUEST YOU AS FOLLOWS:
UPON RECEIPT FROM OUR SIDE OF ANY FUTURE SETTLEMENT INSTRUCTIONS WITH ISIN CODE RU000A1025V3 (RUSAL COMMON SHARES), PLEASE PROCEED WITH SETTLEMENT OF THE RU LINE OF THESE SECURITIES (DEPOSITORY CODE RU000A1025V3).
WE CONFIRM THAT WE DO NOT INTEND TO USE OUR ACCOUNTS WITH AO UNICREDIT BANK FOR SETTLEMENT OF RUSAL’S HK LINE (DEPOSITORY CODE 224072805).
WE AGREE TO INDEMNIFY AO UNICREDIT BANK AND HOLD IT HARMLESS AGAINST ANY LOSSES, CLAIMS, OR EXPENSES ARISING OUT OF OR IN CONNECTION WITH THIS INSTRUCTION.

If it is not convenient for a client to populate field 35B: in MT540-MT543 instructions as described in our previous Newsflash, this MT599 standing instruction will be accepted on our side as an alternative solution, provided that the relevant client plans to settle only the RU line in our books in the future.

Impact on investors: Clients who plan to keep and settle only the RU line of UC RUSAL ordinary shares in the books of AO UniCredit Bank, may provide a MT599 standing instruction, as defined above, to simplify the STP settlement of all future transactions in this security.
